Martinovic: The verdict will not be final

The verdict for the attempted terrorism on the 2016 election day, is the first instance verdict, it is not final, and an appeal or other remedy can be filed against it, lawyer Nikola Martinovic explained.

He told the Radio Montenegro that it is hard to talk about what penalties could be imposed, because there is no corresponding jurisprudence in our country.

"The maximum sentence for the above-mentioned criminal acts is more than five years. Criminal sanctions for these criminal offenses are very high, but having in mind that the range of sentences in our judiciary is wide, from a minimum to a maximum of five to ten years, or that certain statutory regulations enable potential reduction of sentences , it seems ungrateful to talk about what penalties can be imposed, because we do not have the practice of such criminal policy, " Martinovic said.

He said that the decision of the court is still unknown, so the presumption of innocence should not be violated.

He clarifies that the judicial council has scheduled a public announcement of the verdict, which implies informing the participants on the outcome of proceeding, or on the conclusion reached by the court after the evidentiary proceedings.

Thereafter, a written judgment is delivered to the parties in the proceedings, after which they all have 15 days deadline to file an appeal.

"The judgment to be pronounced tomorrow is the first-instance verdict, so it's not final. Everyone has the right to file a regular remedy, or appeal against it," Martinovic says.
